
Definitions, Rules and Policies
| Hedge | Shrubs or bushes (excluding trees) planted or grown in close proximity to each other to create a barrier, typically in lieu of a fence. Hedges are subject to the height restrictions applicable to fences. |
| Shed | A storage unit intended to be stationary or permanent, or that exceeds 48” in height or a 42 SF footprint. (Commercially available plastic deck boxes or storage lockers that do not exceed above specifications are not considered sheds.) The Board must approve all plans for shed construction before work begins. |
| Commercial Vehicle | A vehicle primarily used for a commercial purpose such as transporting passengers for fare, cargo, tools, materials, or equipment, or having been built to perform a specific commercial function. Some examples include: tool trucks, delivery trucks, panel vans, bucket trucks, buses, and other specialty vehicles, as well as vehicles having ladder or equipment racks, etc. (The display of advertisements, magnetic signs, vinyl lettering, etc, or the display of a company name on a vehicle does not automatically define the vehicle as a “commercial vehicle”.) |
| Above Ground Pool | A pool, other than “in-ground”, that is erected or intended to be permanent or semi-permanent and stationary, typically having a depth of 36” or greater, exceeding 100 SF in size, usually constructed of metal and having sidewall braces/supports as well as requiring site-work prior to erection. Also having or requiring a liner, filter and ladder, and often having a deck or slide. (Rigid plastic, Inflatable, inflatable ring and other self-supporting plastic children's pools that are erected temporarily for play in the summer months are defined as a “storable pool” and do not fall under the definition of an “above ground pool”. Any children’s pool less than 24” deep is not, regardless of construction, defined as a “swimming pool”.) |
RECEIVABLES AGING & COLLECTION POLICIES
Every resident of Brownsboro Glen Subdivision
is required to share the cost of the maintenance, improvements and the
providing of services for our subdivision. In order to ensure that every
resident is treated fairly and that no resident is able to ignore his
or her responsibility, the Board of Directors relies on the following
policies. These policies are simply a formal statement of the procedures
used, and should not be construed as to alter the “Declaration of
Restrictions”.
- All maintenance fees, charges, assessments or other monies owed to Brownsboro Glen Homeowners Association, Inc. shall be due and payable on the first day of January of each year.
- Any monies not remitted within (30) days of the due date will be considered Past Due and a second invoice will be mailed, as well as a possible courtesy phone call or visit.
- Any monies not received within (60) days of the due date will be considered Delinquent and may be aggressively pursued using follow-up invoices/ letters, phone calls, and/or visits.
- Any monies not collected within (90) days of the due date will be considered In Default and will be immediately referred to outside parties for collection and legal action, including but not limited to, the automatic filing of a lien on the property.
- All fees or costs expended to collect the monies owed to Brownsboro Glen Homeowners Association, Inc. will be added to the amount owed, and where allowed by law, may accrue additional finance charges.
- If you are unable to meet your obligation, special payment arrangements may be considered ONLY if such arrangements are made before the obligation becomes Past Due (30 days).
NO SOLICITING
After numerous and continuing complaints
and with the recommend-ation of the Louisville Metro Police Department,
The Board of Directors of Brownsboro Glen Homeowners Association voted
to enact a No Solicitation Policy. Signs are posted at both entrances
informing everyone who enters Brownsboro Glen that they may not solicit
or place advertisements throughout our neighborhood.
However, in order for residents to have the ability to go door-to-door if they choose (for example; Boy Scouts, Girl Scouts, Schools, etc.), by request, a “badge” will be made available to any resident wishing to go
door-to-door. Also, if a resident
intends to distribute printed flyers, the
resident’s name and address MUST be
clearly indicated on the flyer in order to distinguish residents from
unauthorized solicitations.
This policy gives us the best of both
worlds - No outside solicitors (and thus enhanced security) and the
freedom for ONLY our neighbors to solicit.
Any solicitor who comes to your door
and cannot identify themselves by name, address and with a BGHOA badge
should be told to leave the subdivision immediately or the police will
be called. A “No Solicitation Notice” is available that can
simply be handed to any solicitor at your door. The notice is
accessible on our website or can be secured from any board member.
If a solicitor becomes belligerent at any time or fails to leave, contact
LMPD non-emergency dispatch at 574-2111 immediately.
